Tryspire is an independent design practice that creates and shares digital files, designs, prototypes, and documentation (the "Content") across three categories:
Free, Open-Source Designs - Educational and experimental concepts in functional 3D printing, ergonomic design, and assistive aid development. Shared under Creative Commons BY-NC-SA or OCL v1.0 licensing for community use and iteration.
Paid Custom Projects - Bespoke design work commissioned by clients. These may be kept proprietary, released under custom licensing, or open-sourced depending on the project agreement.
Paid Proprietary Designs - Commercial products and designs offered for sale. These are not open-source and do not focus on assistive or rehabilitative applications.
These Terms apply to all Tryspire Content. Specific licensing terms for each design are noted on the download platform or in project agreements. Tryspire creates Content to enable makers, designers, engineers, and enthusiasts to learn, experiment, and iterate on functional design concepts.
Sections 3-12 of these Terms apply fully to free, open-source designs shared under Creative Commons or OCL licensing. These designs are provided for educational and experimental use at no cost.
Paid custom projects are governed by a separate written project agreement between you and Tryspire. That agreement specifies licensing terms, deliverables, intellectual property ownership, and use restrictions. These general Terms serve as a foundation, but the project agreement takes precedence for custom work.
Paid proprietary designs are governed by a separate product-specific Terms of Service and licensing agreement provided at the time of purchase. That agreement governs your rights, limitations, warranties, and liability. These general Terms provide baseline protections for Tryspire but do not override product-specific terms.
Critical: This section applies to free, open-source designs. Paid proprietary designs are not positioned as medical devices or assistive aids and are governed by separate ToS.
The free, open-source Content is not a medical device, drug, supplement, or therapeutic intervention under the laws of Canada, the United States, or any other jurisdiction.
These designs have not been evaluated, approved, cleared, or endorsed by Health Canada, the U.S. Food and Drug Administration (FDA), or any other regulatory authority.
These designs are not intended to diagnose, treat, cure, mitigate, prevent, or manage any disease, disorder, condition, or abnormal physical state.
These designs are not a substitute for professional medical advice, diagnosis, or treatment from a licensed healthcare provider.
These designs are not intended for use in clinical, therapeutic, or rehabilitative settings without independent professional evaluation and regulatory compliance by the healthcare provider using them.
If you have a medical condition or concern, consult a qualified healthcare professional before using, adapting, or manufacturing any design based on Tryspire's Content.
By downloading or using the Content, you agree that you are:
Using these designs for personal, non-commercial experimentation and learning.
Not relying on these designs as a finished, validated, or clinically safe product.
Aware that Tryspire has conducted no formal safety testing, clinical validation, or regulatory compliance work on any design.
Responsible for evaluating whether a design is appropriate for your own use case and for conducting your own safety assessments.
These designs may inspire or inform professional work in healthcare, engineering, or assistive technology. However, Tryspire provides no warranty that any design is suitable for that purpose.
By downloading the Content, you acknowledge and accept that:
You are the manufacturer of any physical object resulting from Tryspire's digital files.
Tryspire provides only digital design files, not physical products or manufacturing services.
You assume 100% of the liability, risk, and responsibility for any object you manufacture based on these files.
This includes full responsibility for:
Choosing materials appropriate for your intended use (e.g., food-safe materials if the object will contact food; skin-safe materials if it will contact skin).
Verifying material compatibility with your specific application.
Ensuring the material has no known allergenic or toxic properties for your use case.
Determining appropriate infill density, wall thickness, layer height, and print orientation for your specific use case.
Ensuring the printed part is structurally sound and capable of withstanding the stresses it will experience in use.
Testing the part's mechanical properties (strength, flexibility, durability) before use.
Understanding that different printers, materials, and settings can produce dramatically different results.
Removing all support material, print artifacts, and rough edges.
Inspecting the part for cracks, weak points, delamination, or other defects.
Sanding, smoothing, or finishing the part as needed to ensure safe contact with skin or other surfaces.
Sterilizing or disinfecting the part if it will contact open wounds or mucous membranes.
Conducting your own functional and safety tests appropriate to your intended use.
If the part will support body weight, bear repetitive stress, or contact skin for extended periods, you are responsible for validating its safety through testing.
Understanding the limits of 3D-printed materials and design. They are not equivalent to injection-molded or professionally manufactured parts.
Using the part only for purposes you have explicitly evaluated and deemed safe.
Monitoring the part during and after use for signs of degradation or failure.
Discontinuing use immediately if the part shows any signs of cracking, deformation, or structural failure.
The Content is provided "as-is" and "as-available" without any warranties of any kind, express or implied. To the fullest extent permitted by law, Tryspire, Alex Gittens, and all contributors disclaim all warranties, including:
Implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Warranties that the designs are safe, effective, durable, or error-free.
Warranties that the designs will function as intended in any specific application.
Warranties that the designs are free of defects in material or workmanship.
Warranties that the designs comply with applicable laws or regulations in your jurisdiction.
You accept the Content in its current state. Tryspire makes no promise about the quality, accuracy, completeness, or suitability of any design.
To the maximum extent permitted by applicable Canadian and international law, in no event shall Alex Gittens, Tryspire, its contributors, or any associated parties be liable for any damages, losses, or claims arising from your use, misuse, manufacture, or application of the Content, including but not limited to:
Bodily harm, injury, illness, disability, or death.
Allergic reactions, skin irritation, or other adverse health effects.
Psychological harm or emotional distress.
Harm to third parties caused by your use or manufacture of a part based on Tryspire's designs.
Damage to 3D printers, tools, or equipment.
Damage to surrounding property or possessions.
Data loss or corruption.
Loss of income, profit, business opportunity, or use.
Cost of repairs, replacements, or medical treatment.
Legal fees or court costs.
Any damages arising indirectly from your use of the Content, even if advised of the possibility of such damages.
This limitation applies regardless of the cause of action (contract, tort, negligence, strict liability, or otherwise). It also applies even if any remedy fails of its essential purpose.
By downloading and using the Content, you expressly assume all risks associated with:
Manufacturing objects from digital files without professional oversight.
Using untested, unvalidated designs in any context.
Potential failure or malfunction of any printed part.
Harm to yourself or others resulting from your manufacture or use of the designs.
You acknowledge that 3D printing and DIY fabrication carry inherent risks that cannot be fully eliminated. These include fire hazard (from printer malfunction), material toxicity (from overheating or chemical exposure), and structural failure (from design or manufacturing error).
Using the Content does not create:
A professional relationship between you and Tryspire or Alex Gittens.
An obligation for Tryspire to provide support, updates, or improvements to any design.
A duty of care on the part of Tryspire to ensure the safety or suitability of the designs for any particular purpose.
Any liability on Tryspire's part for your interpretation, misuse, or misapplication of the designs.
If a licensed healthcare provider, engineer, or other professional adapts, modifies, or uses any Tryspire design in a clinical, therapeutic, educational, or professional context, that professional assumes full responsibility for:
Determining the regulatory status of the design in their jurisdiction.
Conducting clinical validation, safety testing, and risk assessment appropriate to their use case.
Ensuring compliance with all applicable medical device regulations and healthcare standards.
Obtaining informed consent from any patient or user of the adapted design.
Maintaining records of any modifications, testing, and clinical outcomes.
Tryspire provides no endorsement, validation, or warranty of any professional use of its designs.
You may not:
Represent Tryspire designs as endorsed, approved, or validated by any health authority or regulatory body.
Use Tryspire designs in marketing or promotional materials that imply medical efficacy or clinical safety without explicit disclaimers.
Claim that Tryspire or Alex Gittens endorses your use or application of the designs.
All designs are the intellectual property of Alex Gittens / Tryspire unless otherwise attributed. Digital files are shared under the specific open-source license noted on the download platform (typically Creative Commons BY-NC-SA or OCL v1.0). You may:
Download, print, and manufacture designs for personal, non-commercial use.
Modify designs for your own use (subject to license terms).
Share your modifications or improvements with the community (subject to license terms).
You may not:
Use designs for commercial manufacture or sale without explicit permission and compliance with license terms.
Represent designs as your own original work.
Use designs in a way that suggests endorsement by Tryspire, Alex Gittens, or any health authority.
Sublicense designs beyond the scope of the original open-source license.
If you discover a safety issue, design flaw, or potential hazard in any Tryspire design, you are encouraged to report it through the appropriate platform or contact information. However:
Tryspire cannot guarantee a response to safety reports.
Reporting a hazard does not create liability on Tryspire's part for past use of the design.
You remain responsible for your own safety regardless of whether a known hazard is publicly disclosed.
You are solely responsible for determining whether any Tryspire design is subject to medical device regulation, assistive technology standards, or other legal requirements in your jurisdiction. This includes:
Researching applicable laws in your country and region.
Determining the regulatory classification of any design you manufacture.
Ensuring compliance with all applicable standards and regulations.
Obtaining any necessary approvals, certifications, or clearances before use or distribution.
Tryspire makes no representation regarding the regulatory status of its designs in any jurisdiction and provides no guidance on compliance.
You agree to indemnify, defend, and hold harmless Alex Gittens, Tryspire, and all contributors from any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Your manufacture, use, misuse, or application of the Content.
Your violation of these Terms or any applicable law.
Your infringement of any third-party intellectual property rights in your modifications or use of the designs.
Harm to yourself or third parties caused by your use of the designs.
These Terms are governed by and construed in accordance with:
The laws of the Province of Ontario and the federal laws of Canada.
Any disputes arising from these Terms or your use of the Content shall be subject to the exclusive jurisdiction of the courts in Ottawa, Ontario, Canada.
If you are located outside Canada, you may be subject to additional local laws and regulations that Tryspire does not control or warrant compliance with.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed. All other provisions shall remain in full effect.
These Terms, together with any specific license accompanying the Content on download platforms, constitute the entire agreement between you and Tryspire regarding the Content. Any prior agreements, understandings, or representations are superseded.
Tryspire reserves the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Content after changes are posted constitutes acceptance of the revised Terms.
This section applies to all paid proprietary designs, commercial products, and digital files purchased from Tryspire that are not part of the free, open-source collection and not covered by a custom project agreement.
By purchasing a paid proprietary design, you receive a limited, non-exclusive license to use the files for personal, non-commercial purposes only. You do not receive ownership of the intellectual property.
You may not:
Redistribute, resell, or share the purchased files without explicit written permission.
Use the files for commercial manufacture or sale.
Claim ownership of the design.
Reverse-engineer, modify significantly, or create derivative works for commercial distribution.
Remove copyright notices or licensing information.
Paid proprietary designs are provided "as-is." Tryspire makes no warranty regarding accuracy, functionality, suitability for any particular purpose, or compatibility with specific equipment.
Refund policies for paid proprietary designs are specified at the time of purchase and may vary by product.
To the maximum extent permitted by law, Tryspire is not liable for any damages, losses, or claims arising from your use of a paid proprietary design, including personal injury, property damage, or economic losses.
Paid custom projects are governed by a separate written project agreement executed between you and Tryspire before work begins.
The project agreement specifies:
Scope of work and deliverables
Payment terms and schedule
Intellectual property ownership and licensing
Confidentiality and use restrictions
Whether the project may be open-sourced after completion
Revision and approval process
In the event of conflict between these general Terms and a custom project agreement, the project agreement takes precedence.
Custom project agreements specify whether Tryspire retains IP rights, transfers them to the client, or applies open-source licensing. This is determined on a per-project basis.
